DIGITAL PRODUCTS / DIGITAL DESIGNS
Because all design services are digital deliverables, they cannot be returned and are, therefore, non-refundable. All payments made to any graphic designer for design work are essentially for labor hours, not the design files. The creative energy and time it requires to create the designs has already been spent by the time deliverables exist. Therefore, all sales are final. Sales are final due to the nature of the customized, downloadable files and unlimited access to them once delivered. Digital products and/or digital designs include (but are not limited to) business cards, flyers, social media designs, posters, banners and logos. This also includes custom designs and instant downloads.
Payment of retainer deposits signifies an official commitment to a project. Christina Burns Design will rely upon that commitment for future scheduling of staff, quotation of resource availability to other prospective clients, and may defer other profitable opportunities in order to work a committed project. It is impossible to quantify the potential opportunity loss caused by a project cancellation. Therefore, no refunds will be issued for any services of any kind (including but not limited to web development, graphic design, marketing, web design, consulting, content writing SEO, ongoing site maintenance, subscription-based services, etc.).
Cancellation of the project at the request of the client must be made in writing. In the event cancellation is requested, we shall have the right to retain all payments to date, and any invoiced amounts will be deemed payable on the contract. In the event this amount is not sufficient to cover the time and expense already invested in the project, additional payment will be due for the hours incurred at an hourly rate of $85.00. If a project is canceled or postponed, all monies paid are retained by Christina Burns Design. If at any point you wish to cancel a service in the process, all paid fees up to that point in the process are non-refundable. The non-refundable policy also includes and is not limited to all retainer or deposit fees paid, even if the project has not yet started, as resources are reserved and confirmed for your project at the time of the initial payment.
Christina Burns Design reserves the right to refuse services that include (but are not limited to) the promotion, advertising, editing, or designing of any form/type of pornography, gang activities, humiliation/bullying, racism, offensive, indecent or improper material, any material that could give rise to any civil or criminal liability under applicable law; and any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material if applicable. We will refuse an order, which in our opinion may be illegal in nature or an infringement on the rights of any third party.
